Terms & Conditions

Please read carefully these terms and conditions before PURCHASING OUR CERTICATION PROGRAMME, THE ONLINE DOCUMENT, ONLINE TRANING PROGRAMME AND FACE TO FACE PROGRAMME. Your purchase, subscription and use of the service indicates your acceptance of the privacy policy and the Terms of Use of the service. If you do not accept these Terms of Use, you will not be allowed to continue with your purchase or registration.

  1. Definitions of Terms:
    1. Service: Refers to either the certification programme, the online document, the online training programme or the face to face training programme. the EIM e-Learning Service, simply the process of learning delivered through the Internet using variety of methods, such as self-guided courses or real-time training with an instructor online.
    2. FTL: Franchise Training Limited, a company incorporated in England and Wales .
    3. Subscriber: Any registered customer to the any of the service and has willingly accepted the Terms of Use of the service and Privacy Policy.
    4. Agreement: Refers to the mutual understanding between the customer and FTL on the use of the service.
    5. User Name: Refers to the registered name of the subscriber of the service.
    6. Password: The registered customer login code to access the service
    7. Course: Refers to a topic or subject required by the subscriber to learn. The course is a textual and graphical aid to learning, accessible from the Internet or the face-to-face training conducted by the FTL from time to time.
    8. Document: refers to the Online document or any other document supplied to the Customer by FTL or any of its associates.
  2. Terms of service
    1. Subscription to online certification will be immediately effective as soon as the final confirmation of the order has been made by the customer and has been successfully acknowledged automatically by the system.
    2. Subscription to online certification will be valid for a period of the course duly notified by FTL to the Customer and access will be granted from the date the service commences.
    3. Online training materials and online documents where relevant will be sent directly to the Customer at the e-mail address given to us and proof of the documents sent by our e-mail system will be proof of delivery. Customers are advised to inform us of any change of e-mail address. The documents will only be sent once unless the Customer can prove that the documents have not or failed to reach the designated e-mail address.
    4. Face to face training bookings will be given a confirmation date chosen by the Customer or alternative date approved by the Customer where Customer or any nominated person will attend the course at the designated place. The Customer or the nominated person must attend the designated course at the designated date unless a special approval has been given for the person to attend courses at different date. We do not normally accept cancellation of the face to face training. However we accept changes in delegates. However, in a very limited circumstances we will allow changes of date and request must be submitted to us by e-mail and such request must have been approved by us by sending you a confirmation e-mail. Face to face trainings are available for any Customers who are able to attend such courses at the designated place in the United Kingdom .
  3. Termination of the service
    1. Customers who wish to discontinue the online certification and online training programmes may do so at any time. However, no refund will be made.
    2. FTL reserves the right, in its sole discretion, to restrict, suspend or terminate the customers access to all or any part of the Service at any time for any reason without prior notice. Customers will be refunded for the portion undelivered to the Customer. However if Customers have been sent all the materials for such training or programme, we will nor refund the money paid, but we will allow extra tutorial sessions to take place.
  4. Customer Responsibility
    1. Where relevant, it shall be the responsibility of the customer to secure their login Username and Password.
    2. The Customer shall be responsible of his/her account and he/she shall not share nor sell his/her subscription to any other party. The access shall be solely used by the account holder only. Any breach of this terms may result in the termination of service and we shall not issue any refund for such breach.
    3. It shall be the responsibility of the corporate customers to maintain the online trainings subscription limited to their employees only. Re-sale or use of the service by other than the employees will not be permitted.
    4. The customer shall be responsible for obtaining Internet connection necessary to access and use of the online services. The customer shall be responsible for all charges associated with accessing and maintaining a connection to the Service including, but not limited to, charges imposed by an Internet service provider, or the customer local telephone company.
  5. Grant of License:

    FTL grants the customer the right to use the Service that contains information, software, photographs, audio and video clips, graphics and other material (collectively, the "Content") for the customer own individual (non-commercial) use. The customer may not share the access nor distribute any Content to others without the prior written permission of FTL.

  6. Use of Service Content:
    1. The customer acknowledges that the Service contains Content that is protected by copyright, trademark or other proprietary rights of FTL, its affiliates, or third parties (if any). All content is copyrighted as a collective work of FTL pursuant to applicable copyright law or has been licensed by FTL. The customer agrees to comply with any additional copyright notices, information, or restrictions contained in any Content available on or accessed through the Service. The Content is intended for the individual, non commercial use of the registered subscribers of the Service.
    1. The customer may not modify, publish, transmit, transfer or sell, reproduce, create derivative works from, distribute, perform, display, or in any way exploit, any of the Content, in whole or in part, except as expressly permitted in this Agreement. Content consisting of or containing downloadable software may not be reverse engineered unless specifically authorized by the owner of the software's patent and/or copyright.
    2. The Customer may download or copy the Content only for the customer own individual use, and further provided that you maintain all copyright and other notices contained in such Content. The customer shall not store electronically any significant portion of any Content, except as may be temporarily stored by the customer Browser in its ordinary operation. Except as expressly permitted by the copyright laws, no copying, storage, redistribution or publication of any Content is permitted without the express permission of FTL or the owners of such Content.
    3. The customer may download or copy from the Service any Content in the public domain (content that is not protected by copyright or other law) for the customer own individual use or for noncommercial redistribution. The customer assume all risk and responsibility for determining whether any Content is in the public domain, regardless of any notices that may be posted on such Content.
    4. The customer grant to FTL the right to edit, copy, publish, distribute, translate and otherwise use any Content that the customer places on the Service, in any medium. The customer represent and warrant that he/she is authorized to grant all rights set forth in the preceding sentence.
  7. Service Rules of Conduct:

    The customer may use the community forum for lawful purposes only. The customer may not upload to, or distribute or otherwise publish through the Service, any Content which (a) is libelous, defamatory, obscene, pornographic, abusive, harassing or threatening, or otherwise objectionable to FTL in its sole and absolute discretion, (b) contains viruses or other contaminating or destructive features, (c) violates the rights of others, such as Content which infringes any copyright, trademark, patent, trade secret or violates any right of privacy or publicity, or (d) otherwise violates any applicable law. The customer may not use the Service for any commercial purpose and may not distribute over the Service any advertising or solicitation of funds or goods and services. In addition, the customer may not use the Service to solicit subscribers to join other online information services that are competitive with the Service.

  8. Managing Content: 

    FTL does not and cannot review the content posted at the community service by the customer, and is not responsible for such Content. However, FTL reserves the right to cancel the customer access to these areas and/or delete, move, or edit any customer Content (including messages posted in any forum) that it may determine, in its sole discretion, violates this Agreement. The customer shall remain solely responsible for all Content posted by the customer or by any other person using the customer account. FTL shall have the right, but not the obligation, to correct any errors or omissions in any Content, as it may determine in its sole discretion.

  9. Subscriber Information:  

    Unless the customer selects otherwise by making the appropriate selection on the FTL personal information page, FTL shall have the right to disclose certain limited subscriber information including, but not limited to, the subscriber's name, e-mail and mailing address, to affiliates, partners and third party vendors for the purpose of providing subscribers with information about products and services. FTL shall also have the right to disclose aggregate information about subscriber usage and demographics in a manner that does not reveal the personal identity of any individual subscriber. FTL shall have the right to send the customer electronic mail to inform him/her of changes or additions to the Service, or of any products and services of FTL. For additional information, refer to our Privacy Policy.

  10. Service and System Availability:   

    FTL uses reasonable efforts to maximize system availability. Should technical difficulties occur with the Service, FTL shall make a reasonable effort to correct the problem and is not responsible for any down time. FTL is not responsible for any technical difficulties resulting from the World Wide Web, Internet access, computer hardware or software.

  11. Indemnity:    

    The customer hereby agree to indemnify, defend and hold FTL, and all of its officers, directors, employees, owners, agents, information providers, affiliates and licensors (collectively, the "FTL Representatives") harmless from and against any and all liability, losses, costs and expenses (including attorneys' fees) incurred by FTL or any FTL Representative in connection with any claim arising out of any use or alleged use of the customer account or password by any person, whether or not authorized by the customer. FTL reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by the customer, and in such case, the customer agrees to cooperate with FTL defence of such claim.

  12. Disclaimers of Warrantees; Limitation of Liability: 
    1. THE SERVICE AND THE CONTENT ARE DISTRIBUTED ON AN "AS IS, AS AVAILABLE" BASIS. NONE OF FTL, THIRD PARTY CONTENT PROVIDERS AND THEIR RESPECTIVE AGENTS MAKE ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF TITLE OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, WITH RESPECT TO THE SERVICE, ANY CONTENT OR ANY PRODUCTS OR SERVICES SOLD THROUGH THE SERVICE. THE CUSTOMER EXPRESSLY AGREES THAT THE ENTIRE RISK AS TO THE QUALITY AND PERFORMANCE OF THE SERVICE AND THE ACCURACY OR COMPLETENESS OF THE CONTENT IS ASSUMED SOLELY BY THE CUSTOMER. NEITHER FTL NOR ANY PROVIDER OF THIRD PARTY CONTENT OR THEIR RESPECTIVE AGENTS WARRANTS THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE; NOR DOES FTL, ANY THIRD PARTY CONTENT PROVIDER, OR THEIR RESPECTIVE AGENTS MAKE ANY WARRANTY AS TO THE RESULTS TO BE OBTAINED FROM USE OF THE SERVICE OR THE CONTENT.
    2. NEITHER FTL, ANY THIRD PARTY CONTENT PROVIDER NOR THEIR RESPECTIVE AGENTS SHALL BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OF OR INABILITY TO USE THE SERVICE, EVEN IF SUCH PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
    3. FTL CANNOT BE HELD LIABLE FOR FAILURE OF THE CUSTOMERS TO OBTAIN ANY JOB OR PROMOTION AS A RESULT OF UNDERGOING THE TRAININGS OFFERED BY FTL AND FTL SHALL NOT BE HELD LIABLE FOR ANY LOSS WHATSOEVER SUCH AS LOSS OF PROFIT AS A RESULT OF UNDERGOING SUCH TRAINING.
    4. FTL IS NOT A PROFESSIONAL ADVISOR AND CANNOT BE TREATED AS SUCH. CUSTOMERS SHOULD ALWAYS CONSULT PROFESSIONAL ADVISORS WHEN MAKING ANY BUSINESS OR LEGAL DECISION.
  13. Indemnity:

    The provisions of paragraphs 6, 7, 12, 13 and 16 are for the benefit of FTL, Third Party Content providers and their respective employees, agents and contractors; and each such party will have the right to enforce such provisions directly on its own behalf.

  14. Customer Privacy:    

    Please refer to our Customer Privacy Policy.

  15. Secured Purchases on the Service:   

    FTL grants the customer a safe shopping guarantee by using state of the art technologies

  16. Miscellaneous:    

This Agreement shall be construed in accordance with the laws of England and Wales and the parties irrevocably consent to bring any action to enforce this Agreement in the courts located in England and Wales . This Agreement constitutes the entire agreement between the parties with respect to the subject matter hereof, and supersedes all previous written or oral agreements between the parties with respect to such subject matter. These Terms of Use may be amended without prior notification from ETISALAT.


THE ABOVE TERMS AND CONDITIONS ON THE USE OF THE SERVICE WILL BE AN INTEGRAL PART OF THE STANDARD TERMS AND CONDITIONS OF ANY SUBSCRIPTION TO FTL SERVICES.
